What is A Domestic Violence Application?
In Queensland, a domestic violence application is a legal channel aimed to protect individuals from abusive or dangerous situations within a domestic setting. It involves lodging an application with the court for a Domestic Violence Order (DVO) against the alleged perpetrator. This order may prohibit contact, communication, and proximity to the applicant in order to ensure their safety. An application for domestic violence can encompass incidences of physical, emotional or financial abuse, stalking or coercive behaviour.
Who Can Make A Domestic Violence Application?
Since September 2012, the law has provided protection from violence to those who have been involved in, or are involved in:
- A close personal relationship, such as de facto, engaged, dating, or married.
- An informal care relationship occurs when a person is reliant on another for assistance with a daily life activity such as shopping, banking, cooking or dressing.
- A family relationship: a child, relative, a parent or former parent.
The Domestic and Family Violence Protection Act of 2012 does not protect:
- Neighbours, Flatmates, or Roommates.
- Children under the age of 18 are violent towards their parents. This falls under the scope of the child protection system.
